$3,600,000.00

Settlement of $3,600,000.00 for a young girl who went into the hospital for routine procedure.  During treatment developed pneumonia resulting in the loss of oxygen to the brain, resulting in a permanent vegetative state.

She developed a pneumothorax resulting in oxygen being deprived to her brain which resulted in her needing 24 hour lifetime care. Significant witness for Plaintiff was an expert listing a detailed list of expenses for her lifetime care.

$1,200,000.00

Settlement for Plaintiff in the amount of $1,200,000.00. Plaintiff a female complained of nausea, vomiting over multiple years. She was misdiagnosed, an MRI was misread that showed a brain tumor. She suffered for more than a year. She was finally diagnosed correctly by her eye doctor. After removal of the tumor, left with multiple disabilities.

$450,000.00

Settlement for Plaintiff in the amount of $450,000.00. Plaintiff was returning late on Route 64 North headed westbound. As the Plaintiff approached another restaurant he saw a tractor trailer was stretched crosswise across Route 64 and invisible to him until it was too late. The accident was recreated with vehicle, Jeep Cherokee with a camera attached to the dashboard with distance markers implanted on Route 64 every 50 feet showing it impossible to see the tractor trailer at the approximate speed limit.

$400,000.00

Settlement of $400,000.00 for the Estate of Baby Boy that involved the death of a newborn baby who was suffering from fetal distress.  His death resulted from encomium aspiration syndrome.  The matter settled on the first day of trial for the Plaintiff.

$186,415.88

Verdict  for Condemnee as compensation for the taking.  The State of New Jersey has previously valued the taking at approximately $30,000.00.  The land was to be taken for the extension of Route 78.

$500,000.00

Another condemnation case represented a private landowner whose property was in the same location as the first condemnation matter, there was a meager offer made to the landowner but resulted in a $500,000.00 offer during the trial of the matter."

$52,280.00

Verdict for Plaintiff in the amount of $52,280.00 for a motor vehicle collision.  The trial resulted in a verdict for the Plaintiff, with no offers from the Defendant prior to trial.  

Selected Criminal Trials:

State of NJ v. John Doe.  John Doe had been stopped for purposes of a DUI investigation.John Doe was alleged to be in a possession of a handgun found in the car.   The defense lead by Attorney Ferguson successfully argued that the vehicle was owned by a friend of John Doe and he was unaware of the handgun being in the vehicle.

State of NJ v. John Doe.  Following a two and half week trial in which the State was represented by Warren County Prosecutor Thomas S. Ferguson. John Doe was found guilty of 1st degree aggravated sexual assault and robbery for an attack on a young woman.  This was an unsolved crime until the DNA from the crime scene was reprocessed through the CODIS system resulting in a “hit” against John Doe.  The trial was one of the first CODIS “hit” cases tried in New Jersey.  John Doe, who had an extensive criminal history was sentenced to thirty years in New Jersey State Prison.

State of New Jersey v. John Doe.  The matter involved alleged activities in a retail establishment that resulted in first degree robbery charges against John Doe.  His defense included a lack of involvement in the robbery and the potential involvement of certain witnesses who testified against him.  Outcome: Acquittal

State of New Jersey v. John Doe  This matter involved a double indictment on First Degree Sexual Assault case in which the father of two young children was accused of aggravated sexual assault against both children, one being an infant and the other a young child at the time.  The case involved a D.Y.F.S. investigation including a filmed interview with one of the children conducted by the D.Y.F.S. caseworker.  There was an emergent appeal to the Appellate Division by the defense that was denied in this matter whereby the sitting judge barred the Defendant from the courtroom during the testimony of the victim, which ruling was upheld.  The trial also included testimony from the Defendant’s estranged wife and a daycare provider indicating the Defendant’s involvement.  The defense articulated the defense that the children have literally been taught that they were molested by the investigative process.  Outcome: Acquittal.

State of New Jersey v.
